    John Emery Jr. came with his father to Newbury in 1635. Selectman, 1670-1673;
    jury of trials, 1675-1676; chosen to carry votes to Salem 1675-1676; chosen to
    serve on jury of trials at Ipswich; tything-man, 1679; way-warden, 1679. In
    1642 he had laid out to him fourscore acres over the Artichoke or Raspberry
    River. Forty acres of this land was a grant of the town of Newbury to John
    Emery Senior, and by him given to his son in consideration of love and
    affection. The remaining forty acres were bought of Archelaus Woodman for
    thirty pounds, being a town grant to him. This tract of land has been in
    possession of the name since it was laid out to John Emery, junior; and now,
    included in the farm of the late Eliphalet Emery, Esquire of West Newbury, is
    owned by his daughter Mrs. Mary Hale Emery. In 3 March 1679 "the town of
    (Newbury) granted John Emery, junior, twelve acres of land on the west side of
    Artichoke River, provided he build and maintain a corn mill to grand the town's
    corn from time to time and to build it within one year and a half after the
    date hereof." This mill is now known as Curzons Mills, Newburyport,
    Massachusetts. John Emery, junior was a signer of the petition in the case of
    Lieut. Robert Pike, and a member of the Woodman party in the church
    difficulties. He is styled Sergeant on the records. He was made freeman 30
    May 1660; made his will 3 August 1693.

    Notes:

    John Emery, senior, sailed from Southampton, April 3, 1635, with his brother
    Anthony in the ship James of London, William Cooper, Master, their wives and
    one or two children each probably with them; he landed in Boston, 3 June 1635,
    and went soon after to Newbury where John, senior, had a town grant of half an
    acre for a house lot. John Emery was fined 22 December 1637, by the town,
    twenty shillings for inclosing ground not laid out, or owned by the town,
    contrary to a town order, and on 1 February 1638, the town granted him that
    part of ground which was already inclosed. He was made freeman 2 June 1641,
    and recorded as one of the ninety-one freeholders of the town 2 December 1642;
    in the same year he was appointed with three others to make a valuation of all
    the property in the town, for the purpose of proportioning each man's share in
    the new division. On 16 March 1663, John Emery was presented to the Court at
    Ipswich by Henry Jaques, Constable of Newbury, for entertaining travellers and
    Quakers. 5 May 1663 his presentment for entertaining Quakers was referred unto
    next Court. The next Court fined him four pounds, costs and fees for
    entertaining strangers. The evidence given in the case was "yt two men quakers
    wr entertained very kindly to bed and table & John Emmerie shok ym by ye hand
    and bid ym welcome." Also, "that the witness heard John Emery and his wife say
    that he had entertained quakers and that he would not put them from his house
    and used argument for the lawfulness of it." John Emery in May, 1663,
    petitioned the General Court for the remission of his fine. His petition was
    signed by the selectmen of the town and fifty of the citizens. The fine was
    not remitted.

    He was also prominent in the case of Lieut. Robert Pike, refusing to recognize
    the authority of the Court to deprive him and his neighbors of the right of
    petition. In the famouse ecelesiastical difficulties John Emery was a member
    of the Woodman party.

    10 April 1644 he had a grant from the town of twenty-two acres and five rods
    being his own and Henry Palmer's portion of "Divident" land in the great field
    beyond the new town. He was selectman, 1661; fence viewer, 1666; grand juryman
    in the same year; jury of trials in 1672; appointed to carry votes to Salem in
    1676.

    John Emery made his will 1 May 1680, proved 27 November 1683, in which he
    mentions his age as eighty-three years. The inventory of his estate was taken
    in the same day, amounting to 263 poinds, 11 shillings.

    Notes:

    John Webster came from Ipswich, Suffolk County, England, around 1631 to Ipswich,
    Massachusetts, where he was made a freeman in 1635. He was a baker by trade,
    admitted an inhabitant of Salem in 1637 and had a grant of land. He was a
    witness in the Essex court in 1639 and applied for land at the Creek in 1642.
    He died soon after coming here, leaving four sons and four daughters. The
    family subsequently moved to Newbury.

    Petition of Mary widow of John Webster, that her eldest son, John, should have the land called the farm, of about 32 acres, which lyeth between Mr. Rogers oxe pasture and Thomas Bishop's farm, when he is twenty-one years, he to pay Nathan the youngest child 5li at fourteen years or if he refuse that Elizabeth, Abigail and Israell have 20 nobles each, when twenty one; the dwelling house and 6 acres of land tied to make it good. The Court, Nov 4, 1646, granted that the estate be ordered as the widow desired and apointed her administratrix, to give bond for security in such sum as the next Ipswich court shall approve and receive of her the inventory amount to 147li. 5s. (Mass Bay Colony Records, vol 2, p. 184.)
    John Emery of Newbury married Mary, widow of John Webster, late of Ipswich, and she had power from the Court to administer and dispose of his goods to his children. Some of the children now grown, almost ready to receive their portions, John Emery petitions for liberty to sell the Island which is devided to three of the children, and also the house and 6 acres of land which was bound to make good the 20li. to the other three, and upon grant of this, binds himself to pay the children the full price he shall sell it at, and to the other three children, who are to have 20 nobles, to make good to them the 8li. apiece and to pay the daughter their portions at eighteen and the sons at twenty-one years.
